Public statement against denial of reservation in Calicut University

Calicut University must give immediate appointments to Dalit candidates as per reservation norms, based on the verdict of the Honourable Supreme Court and the order of Kerala State Commission for Scheduled Castes and Scheduled Tribes.

Dr. T.S. Syamkumar, Dr. Tara, and Dr. Suresh Kumar Puthanparambil lost their chances of getting appointed as Assistant Professors at Calicut University as the University subverted the reservation roster in the rank list published in 2021. According to the reservation norms and KS and SSR rules, SC/ST reservations should be implemented in Roster 4, 12, 32, and 52. But as the University completely overturned this reservation sequence, Dr. Tara, who should be at 4th Turn, Dr. Suresh, who should be at 24th Turn in the Malayalam Department, and Dr. Syamkumar, who should be at 32nd Turn in the Sanskrit Department, did not get an appointment. They missed the opportunities only because the university subverted the SC/ST reservation criteria and norms. Based on their complaint, the Kerala State SC/ST Commission examined and conducted a detailed study into the matter and found that the University had sabotaged the reservation criteria. Based on this finding, the Commission gave an order on September 9, 2023, to rearrange the reservation rotation of Calicut University as per KS and SSR rules from 14 to 17 and to give appointments to Dr. Syamkumar, Dr. Tara, and Dr. Suresh within one month.

It is the vertical reservation criteria adopted by Calicut University that subverted the appointment of the Dalit candidates. It should be noted that these vertical reservation criteria have already been revoked by the Supreme Court itself. Dr. Anupama, who belongs to the reservation category and is included in the same rank list, filed a case in the High Court because she did not get appointed. And she got a verdict in her favour from the division bench. The case filed by Calicut University against this verdict of the Division Bench in the Supreme Court was dismissed, and the Honourable Supreme Court passed an order on May 19, 2023, agreeing with the judgment of the Kerala High Court Division Bench.

This difference in appointment rotation has happened due to the implementation of vertical reservations instead of horizontal reservations by Calicut University for executing reservations. Beyond the chance of any doubt or ambiguity, the Supreme Court has stated that the reservation implemented by the University like this and the appointment chart based on it is not according to the law. Moreover, the Supreme Court has instructed the University to notionally rearrange the rotation chart following the criteria instructed in the cases of Indira Sahani, Anil Kumar Gupta, and Rajkumar Dariya. The Supreme Court has made it clear that during such rearrangements, those who are appointed outside reservation criteria should be appointed to supernumerary posts, and the University will have the freedom to regularize such candidates in future vacancies.

Dr. Anupama got the appointment according to the old reservation criteria, as the Supreme Court abrogated the vertical reservation implemented by Calicut University. However, the University is still reluctant to give due appointments to Dr. Syamkumar, Dr. Tara, and Dr. Suresh, who are involved in similar cases and contexts. This is contempt of court, a Constitutional violation, and sabotage of social justice. Thus the Calicut University authorities are hereby requested to give immediate appointments to these Dalit candidates as per the Supreme Court verdict and the State Schedule Castes and Schedule Tribes Commission’s order.

സുപ്രീംകോടതി വിധിയുടെയും പട്ടികജാതി പട്ടിക ഗോത്രവർഗ്ഗ കമ്മീഷൻ ഉത്തരവിന്റെയും അടിസ്ഥാനത്തിൽ സംവരണ മാനദണ്ഡപ്രകാരം കാലിക്കറ്റ് യൂണിവേഴ്‌സിറ്റി ദലിത് ഉദ്യോഗാർത്ഥികൾക്ക് ഉടൻ നിയമനം നൽകുക

കാലിക്കറ്റ് യൂണിവേഴ്സിറ്റി 2021 ൽ പുറപ്പെടുവിച്ച അസി. പ്രൊഫസർ റാങ്ക് ലിസ്റ്റിൽ യൂണിവേഴ്സിറ്റി സംവരണക്രമം (Reservation Roster) അട്ടിമറിച്ചത് മൂലം നിയമനം  ലഭിക്കാതെ പുറത്തായവരാണ്  ഡോ. ടി.എസ്. ശ്യാംകുമാർ, ഡോ. താര, ഡോ. സുരേഷ് പുത്തൻ പറമ്പിൽ എന്നിവർ. സംവരണ മാനദണ്ഡ പ്രകാരവും KS and SSR റൂൾ അനുസരിച്ചും  4,12,32,52 എന്ന ക്രമത്തിലാണ് എസ്.സി./എസ്.ടി. സംവരണം നടപ്പിലാക്കേണ്ടത്. എന്നാൽ യൂണിവേഴ്സിറ്റി ഈ സംവരണക്രമം സമ്പൂർണമായി അട്ടിമറിച്ചതിനാൽ മലയാളം വിഭാഗത്തിൽ 4 മതായി വരേണ്ട ഡോ. താരക്കും 24 മതായി വരേണ്ട ഡോ. സുരേഷിനും സംസ്കൃത വിഭാഗത്തിൽ 32 മതായി വരേണ്ട ഡോ. ശ്യാംകുമാറിനും നിയമനം ലഭിച്ചില്ല. യൂണിവേഴ്സിറ്റി SC/ST സംവരണ മാനദണ്ഡം അട്ടിമറിച്ചതിലൂടെയാണ് ഇവരുടെ നിയമനം ഇല്ലാതായത്. ഇവർ നൽകിയ പരാതിയുടെ അടിസ്ഥാനത്തിൽ കേരള സംസ്ഥാന പട്ടികജാതി പട്ടികഗോത്രവർഗ്ഗ കമ്മീഷൻ ഈ വിഷയം പരിശോധിക്കുകയും വിശദമായി പഠനം നടത്തുകയും യൂണിവേഴ്സിറ്റി സംവരണം അട്ടിമറിച്ചതായി കണ്ടെത്തുകയും ചെയ്തു. ഇതിന്റെ അടിസ്ഥാനത്തിൽ KS and SSR ന്റെ 14 മുതൽ 17 വരെയുള്ള റൂൾ പ്രകാരം കാലിക്കറ്റ് യൂണിവേഴ്സിറ്റി സംവരണ റൊട്ടേഷൻ പുന:ക്രമീകരിച്ച് ഒരു മാസത്തിനകം അസി. പ്രൊഫസർ തസ്തികയിൽ ഡോ. ശ്യാംകുമാർ, ഡോ. താര, ഡോ. സുരേഷ് എന്നിവരെ നിയമിക്കാൻ 2023 സെപ്റ്റംബർ 9 നു കമ്മീഷൻ ഉത്തരവിട്ടിരിക്കുകയാണ്.

ദലിത് ഉദ്യോഗാർഥികളുടെ സംവരണ മാനദണ്ഡപ്രകാരമുള്ള നിയമനത്തെ അട്ടിമറിച്ചത് കാലിക്കറ്റ് യൂണിവേഴ്‌സിറ്റി അവലംബിച്ച ‘Vertical Reservation’ മാനദണ്ഡമാണ്. ഈ മാനദണ്ഡം സുപ്രീം കോടതി തന്നെ അസാധുവാക്കി ഉത്തരവിറക്കിയിട്ടുള്ളതാണ്. ഇതേ റാങ്ക് ലിസ്റ്റിൽ ഉൾപ്പെട്ട സംവരണ വിഭാഗക്കാരിയായ ഡോ. അനുപമയ്ക്ക് നിയമനം ലഭിക്കാത്തതിനെ തുടർന്ന് ബഹു. ഹൈക്കോടതിയിൽ കേസ് ഫയൽ ചെയ്യുകയും പരാതിക്കാരിക്ക് അനുകൂലമായി ഡിവിഷൻ ബഞ്ച് വിധി പുറപ്പെടുവിക്കുകയും ചെയ്തു. എന്നാൽ ഡിവിഷൻ ബഞ്ച് വിധിയ്ക്കെതിരെ കാലിക്കറ്റ് സർവ്വകലാശാല സുപ്രീം കോടതിയിൽ ഫയൽ ചെയ്ത കേസ് തള്ളിക്കൊണ്ടും ബഹു. ഹൈക്കോടതി ഡിവിഷൻ ബഞ്ച് വിധി അംഗീകരിച്ചു കൊണ്ടും സുപ്രീം കോടതി 2023 മെയ് 19 നു ഉത്തരവിറക്കി.  

യൂണിവേഴ്‌സിറ്റി സംവരണം നടപ്പിലാക്കുന്നതിനായി Horizontal Reservation നു പകരം Vertical Reservation നടപ്പിലാക്കിയത് മൂലമാണ് നിയമന റൊട്ടേഷനിൽ വ്യത്യാസം വന്നിട്ടുള്ളത്. ഇത്തരത്തിൽ യൂണിവേഴ്സിറ്റി നടപ്പിലാക്കിയ സംവരണവും അതിന്റെ അടിസ്ഥാനത്തിൽ തയ്യാറാക്കിയ Appointment Chart –ഉം നിയമപ്രകാരമല്ലെന്ന് സുപ്രീം കോടതി അർത്ഥശങ്കയ്ക്കിടയില്ലാത്ത വിധം ഉത്തരവിലൂടെ വ്യക്തമാക്കിയിട്ടുണ്ട്. മാത്രമല്ല ബഹു. സുപ്രീംകോടതി ഇന്ദിരാ സാഹ്നി, അനിൽകുമാർ ഗുപ്ത, രാജേഷ്കുമാർ ദരിയ എന്നീ കേസുകളിൽ നിർദ്ദേശിച്ചിട്ടുള്ള മാനദണ്ഡങ്ങൾ പാലിച്ച് റൊട്ടേഷൻ ചാർട്ട് നോഷണലായി പുനഃക്രമീകരിക്കണമെന്നും ഇങ്ങനെ പുനഃക്രമീകരിക്കുമ്പോൾ സംവരണ മാനദണ്ഡപ്രകാരല്ലാതെ നിയമിക്കപ്പെട്ടവരെ സൂപ്പർ ന്യുമററി തസ്തികകളിൽ നിയമിക്കണമെന്നും അത്തരക്കാരെ ഭാവിയിൽ ഉണ്ടാകുന്ന ഒഴിവുകളിലേക്ക് സ്ഥിരപ്പെടുത്തുന്നതിന് സർവ്വകലാശാലക്ക് സ്വാതന്ത്ര്യം ഉണ്ടായിരിക്കുമെന്നും കോടതി വ്യക്തമാക്കിയിട്ടുള്ളതാണ്.

കാലിക്കറ്റ് യൂണിവേഴ്‌സിറ്റി അവലംബിച്ച ‘Vertical Reservation’ സുപ്രീം കോടതി അസാധുവാക്കിയത് കൊണ്ടാണ് പഴയ സംവരണ മാനദണ്ഡപ്രകാരം  ഡോ. അനുപമയ്‌ക്ക് നിയമനം ലഭിച്ചത്. എന്നാൽ സമാനമായ കേസിൽ ഉൾപ്പെട്ട ഡോ. ടി.എസ്. ശ്യാംകുമാർ, ഡോ. താര, ഡോ. സുരേഷ് പുത്തൻപറമ്പിൽ എന്നീ ഉദ്യോഗാർത്ഥികൾക്ക് നിയമനം നൽകാൻ യൂണിവേഴ്‌സിറ്റി ഇനിയും തയ്യാറാകുന്നുമില്ല. ഇത് കോടതി അലക്ഷ്യവും ഭരണഘടനാ വിരുദ്ധ നടപടിയും സാമൂഹിക നീതിയെ അട്ടിമറിക്കുന്നതുമാണ്. ആയതിനാൽ സുപ്രീംകോടതി വിധിയുടെയും പട്ടികജാതി പട്ടികഗോത്രവർഗ്ഗ കമ്മീഷൻ ഉത്തരവിന്റെയും അടിസ്ഥാനത്തിൽ സംവരണ മാനദണ്ഡപ്രകാരം കാലിക്കറ്റ് യൂണിവേഴ്‌സിറ്റി  ദലിത് ഉദ്യോഗാർത്ഥികൾക്ക് ഉടൻ നിയമനം നൽകണമെന്നു ഞങ്ങൾ യൂണിവേഴ്‌സിറ്റി അധികാരികളോട് അഭ്യർത്ഥിക്കുന്നു.
